Can kratom get you busted in San Diego?

On Behalf of Turner Law | Oct 10, 2022 | Drug Charges |

Many states and municipalities have legalized the use, sale and possession of kratom. This natural herbal leaf comes from an evergreen tree that is related to the coffee plant. It is indigenous to certain regions of Southeast Asia and has been used for centuries for both pain relief and its stimulant effects in lower dosages.

San Diego is not a kratom-friendly locale, unfortunately for those who have used it as an alternative to traditional opioid drugs. Almost all the surrounding jurisdictions have no laws against it, however. This actually makes it more problematic to possess or use it, because you can get arrested here in San Diego after making your legal purchase from a nearby store.

What are your options?

The easiest way to avoid a drug arrest for kratom is not to possess or use it within the jurisdiction of San Diego. If you are using it for pain relief, that can be challenging.

Certainly, if you buy your kratom at a shop where it is sold legally, you can use it in that area without fear of arrest. But – and this is important – not all police are aware of the legal status of kratom. Because its legal status is subject to change at any time, it is always wise to be aware of any changes in the drug laws of your state, county and city.

Make the best decisions to avoid drug convictions

The nation’s drug laws are currently in a state of flux, and some of those changes could ultimately affect the legal status of kratom here in San Diego and elsewhere. Staying abreast of the changes and seeking guidance after an arrest are two ways to protect yourself from a kratom conviction.
