Background

Is Your Background Record Keeping You From Moving Up?

Most people do not realize how one mistake can stick around for decades. A conviction for criminal charges can prevent you from getting into the military or being hired for contract work at a naval base. You may be skipped over for a promotion, a job, a loan, a scholarship, or a lease for a car or an apartment or denied the chance to get your commercial driver’s license (CDL), but you are not without options.

California has several laws to help people with misdemeanor or felony convictions petition the court for expungement – the removal or dismissal of an arrest or conviction record and background check – or record sealing, which hides the record from the general public. This is a narrow path with many restrictions, and only certain convictions qualify. And bear in mind that sealed records are still visible to some organizations, such as law enforcement, for example.

Still, these criminal justice reform laws could provide the relief you seek and open the doors of opportunity for your future. If you have served your time for certain felony charges – that is, you have completed all the terms of your sentence, from paying all fines, doing community service and serving the mandatory minimum incarceration time to completing probation, parole and whatever else the judge threw your way – and have stayed in good standing with the law with no new felony convictions for at least four years, then you could qualify to have your background record sealed. If your arrest did not result in a conviction, then your record could qualify for automatic sealing.

One mistake shouldn’t define your life. At Turner Law, we have the experience to help you.
